Warranty Remedy
The sole recourse under the foregoing warranty, or any implied warranty, is limited to the replacement or repair of defective parts with parts of equal or greater value at the sole discretion of E-Dash. Except to the extent specifically prohibited by law, under no circumstances will E-Dash be liable for any property damage, personal injury, or death, fire-related incidents, loss of use, loss of opportunities, loss of contract, loss of goodwill, business interruption, loss of profits, loss of causation, or any other direct, indirect, incidental, special, or punitive damages, whether based on contract, warranty, negligence, product liability, or any other theory. E-Dash shall not be liable for any accidents, misuse, abuse, loss, injury to or by the rider, or by a third party, even if the cause is power, speed, incorrect or illegal parameter settings, defect, or malfunction of electric bicycle components. This applies in all cases, regardless of cause, whether for breach of warranty, contract, tort (including negligence), strict liability, or other reasons. By purchasing this equipment, the buyer agrees that, UNDER NO CIRCUMSTANCES SHALL E-Dash BE LIABLE FOR ANY SPECIAL, INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES EVEN IF THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Customer Responsibilities: The customer assumes all responsibilities regarding our electric bicycles, batteries, electric bicycle components, brakes, adjustments, and mechanical bicycle parts, electrical wiring, unforeseen events, safety issues, maintenance, and services, etc. Traffic Regulations and Restrictions: Users of electric bicycles must obey all traffic rules, geographic or age restrictions, and are responsible for following the rules and updates for the type of vehicle they are using. Lithium-Ion Battery Safety: Customers are fully responsible for understanding the safety concerns and regulations related to the maintenance, charging, use, and transportation of lithium-ion battery packs.
